Legal Advice For Teachers To Qualify Length of Service

The Government of Sindh, School Education & Literacy Department has issued the official notification on 3rd February 2022 in connection with Legal Advice For Teachers To Qualify Length of Service of all teaching staff initially appointed on contract basis w.e.f. date of initial appointment.

I am directed to refer to the subject noted above & to state that School Education & Literacy Department has appointed Teaching Staff, from time to time, against permanent & sanctioned posts, but, on contract basis initially for a period of years, through competitive process via Third Party Testing Service.

Subsequently, the teachers were regularized, from time to time, upon successful/satisfactory completion of their contract period(s) through different Acts/Ordinances.

Currently, their contract period is not counted towards qualifying length of service for the purpose of Time-Scale Incentive, Seniority, Promotion, Pension, G.P. Fund & all other fringe benefits. However, the contrary has been proved by the concrete evidences reproduced below.

That, the Honorable Provincial Assembly of Sindh, through “THE SINDH (REGULARIZATION OF CONTRACT EMPLOYEES OF KHAIRPUR MEDICAL COLLEGE, KHAIRPUR) ACT 2015 Sindh Act No. XLIV of 2018. has regularized the contract appointees w.e.f. the Date of their initial Appointment.

That the Honorable Provincial Assembly of Sindh, through “THE SINDH CIVIL SERVANTS (REGULARIZATION OF ADHOC APPOINTMENTS) (AMENDMENT) ACT, 2014” Sindh Act No. XII of 2014, has regularized the ad-hoc appointees w.e.f. the Date of their initial Appointment.

That, in the case of contract teachers appointed in 2001 & then regularized as fresh appointees on 01.10.2005by this Department, vide Order No.SO(S-IV)EDU-E&A-9-14/93, dated 01.10.2005(F/C), the Honorable High Court Sindh, in C.P No. D-1239 of 2009, order dated 13.01.2011 had directed the Secretary, School Education & Literacy Department, that:

Whenever permanent post is to be regularized then it has to be regularized from date or Initial appointment & hence declared that:

Regularization of the petitioner shall be effective from the date of their initial joining in service.

This Department has ensured the full compliance of the order of Hon’ble High Court dated 13.01.2011, in letter & spirit, but such benefits have ONLY been extended to the Successful Petitioners, vide Order No.DSEMPYADMN-11/2834/2021, dated 22.02.2021.
