Punjab Service Tribunal, Lahore has issued the orders of Regularization of contract employees 2021 under Rule-17A from the date of appointment. According to the arguments of Employee’s lawyer, some department are not including the contract service of employees inspite of this court has issued the orders already.

Appellant filed instant appeal under section 4 of the Punjab Service Tribunal Act, 1974 With the mowing prayer:-
“In view of above submission it is therefore most respectfully prayed that this appeal in hand may very kindly be accepted and set aside the impugned order dated 13.12.2019 and appellate order dated 8.7.2020 after declaring the same to illegal, void, arbitrary, discriminatory and facts and the respondents may very kindly be directed to regularize the service of the appellant from the date of induction/initial appointment alongwith all benefits.“
Briefly, the was appointed as Junior Clerk (BS-07) under Rule 17-A of the Punjab Civil Servants (Appointment Conditions of Service) Rules, 1974 on contract basis for a period or three years due to death Of his father during service vide appointment order dated 21.6-2014 issued by the Superintending Engineer, Drainage Circle, Faisalabad.
Aggrieved of the order, appellant filed departmental appeal before the Chief Engineer, Faisalabad Irrigation Zone, Faisalabad which was rejected vide order dated 8.7.2020. Hence this service appeal.
I have considered the arguments of both parties and perused the record. It is established from the record that the appellant was appointed as Junior Clerk (BS-07) under Rule 17-A Of the Punjab Civil Servants (Appointment & Conditions Of Service) Rules, 1974 on contract basis for a period of three years vide appointment order dated 21.6.2014 and thereafter his services were regularized by the respondent department vide order dated 13.12.2019 with immediate effect instead of 21.6.2014 the date from which date appellant was appointed on contract basis.
It has been noticed that the appellant was met with discriminatory treatment which is established from the facts and documentary evidence (appended with the instant appeal) relied upon by the learned Counsel for the appellant that vide judgment dated 28.1.2020 passed by this Tribunal in service appeal No.4582/2019 similarly appointed employee of the office of Animal Nutrition Centre, Rakh Dera Chahl, Lahore on contract basis under Rule 17-A of the Punjab Civil Servants (Appointment & Conditions of Service) Rules, 1974 were regularized from the date of his initial contract appointment.
