Utility Allowance Writ Petition Dismissed Lahore High Court

Lahore High Court has issued the order sheet regarding utility allowance writ petition dismissed by the judge Shams Mehmood Mirza.

This order shall decide the present writ petition as well as connected writ petition No. 220421 of 2018 on account of similarly of facts and the cause of action agitated therein.

The petitioners are civil servants working at various posts different departments of Government of Punjab and are aggrieved by the grant of certain allowances to the officials working in Civil Secretariat in terms of Notifications dated 31-01-2017 and 26-5-2018.

The salary as well as the increments/allowance to be received by a civil servant undoubtedly form part of the terms and conditions of service.

The constitutional jurisdiction of this court is barred in terms of Article 212 of Constitution. It is, therefore, quite evident that the dispute, inter se, the parties to the terms and conditions of service, which attracts the bar of jurisdiction of this court contained in Article 212 of the Constitution.

In the result, this writ petition as well as connected writ petition being not maintainable are dismissed.

So it is bad news for Punjab Govt employees that the utility allowance writ petition dismissed by Lahore high court.
